Third Lawsuit Filed Over FedEx Freight-Bus Crash

The family of a Los Angeles student killed last month when the charter bus he was in was hit by a FedEx Freight truck in Orland, Calif., is filing a wrongful death lawsuit, according to the Los Angeles Times.

UPDATED -- The family of a Los Angeles student killed last month when the charter bus he was in was hit by a FedEx Freight truck in Orland, Calif., is filing a wrongful death lawsuit, according to the Los Angeles Times.

The suit is against the trucking company, as well as the truck manufacturer Volvo and Silverado States, the tour bus company. This third lawsuit is seeking unspecified damages.

The bus was struck by the rig when it crossed a section of Interstate 5 on April 10. Some witnesses reported the FedEx truck was on fire before it hit the chartered bus, but that has not been confirmed by the National Transportation Safety Board, which is investigating the crash.

Ismael Jiminez was among the eight passengers on the bus killed in the crash. Witnesses say he died at the front of the bus while helping other passengers escape the smoke and flames. Also killed in the crash were the bus driver and the FedEx driver.

Last month the attorney representing the mother of a 17-year-old who also died in the mishap filed the first lawsuit in Los Angeles following the crash. It names both FedEx and the bus company as defendants, asking for damages of $100 million.

That suit claims FedEx negligently operated its freight trucks, despite previous incidents of vehicles catching fire due to mechanical problems, driver error or improperly loaded cargo, according to the L.A. Times.

Earlier this month, a second lawsuit stemming from the crash was filed, naming FedEx and the bus company as defendants. It seeks unspecified damages.

An NSTB final report as to the cause of the crash is not expected for several months. A preliminary report was released in late April.
