On October 17, Magistrate Judge Philip Lammens granted a request by the Association of Independent Property Brokers and Agents to lift a stay that was preventing consideration of an AIPBA bid to move the case.
The stay was imposed because the recent government shutdown restricted the federal government’s ability to act on the matter.
Lammen said the broker association and the Federal Motor Carrier Safety Administration must file briefs by October 24 on whether the case should be transferred to the Eleventh Circuit Court of Appeals.
The brokers are pushing for the venue change as part of their fight against the $75,000 bond required under last year’s highway law.
The safety agency began enforcing the requirement October 1.
