Federal Court Rules Against EPA in Navistar Engine Case
The U.S. Environmental Protection Agency has lost a fight with truck engine makers over an earlier decision allowing Navistar International to sell earlier models of its engines with exhaust gas recirculation technology, even though they did not meet federal emissions rules.
The U.S. Environmental Protection Agency has lost a fight with truck engine makers over an earlier decision allowing Navistar International to sell earlier models of its engines with exhaust gas recirculation technology, even though they did not meet federal emissions rules.
The move by U.S. Court of Appeals for the District of Columbia Circuit this week will have little if any effect because Navistar’s current engines meet federal regulations, using the same technology as its competitors, selective catalytic reduction.
Navistar competitors, Daimler, Mack and Volvo, were concerned that allowing the EPA decision allowing Navistar to produce non-conforming engines, while paying a financial penalty, would set a bad precedent.
