The U.S. Environmental Protection Agency has lost a fight with truck engine makers over an earlier decision allowing Navistar International to sell earlier models of its engines with exhaust gas recirculation technology, even though they did not meet federal emissions rules.

The move by U.S. Court of Appeals for the District of Columbia Circuit this week will have little if any effect because Navistar’s current engines meet federal regulations, using the same technology as its competitors, selective catalytic reduction.
