The maker of an alternative antilock braking system has filed suit against federal officials because the government says the product doesn't meet regulatory standards.

ABS Inc., Mount Pleasant, Mich., makes a pneumatic, non-computerized, non-electric antilock braking system, the MSQR-5000. National Highway Transportation Safety Administration officials have ruled that the braking system does not meet Federal Motor Vehicle Safety Standard No. 121 outlining the performance requirements of antilock braking systems.
The company says it's not right that officials based their decision on "a review of promotional material describing the device and the principles involved in its operation." In the suit, filed Aug. 29 against NHTSA and Secretary of Transportation Norman Mineta, ABS Inc. alleges that NHTSA has not tested the product, nor have NHTSA officials been present when the company conducted tests showing the product's compliance with federal standards.
ABS claims that because of this, the company has lost potential sales of its braking system and has been irreparably harmed.
