A man has been charged in U.S. District Court in Worcester, Mass with trying to bribe a federal safety investigator in order to avoid negative findings on a safety review of his motor carrier company, but has already decided to pled guilty to avoid a lesser sentence.

Irfan Dushku, 43, was charged in a one-count of bribery of a public official.

The U.S. Attorney’s Office for the District of Massachusetts alleges that Dushku paid $1,000 to a Federal Motor Carrier Safety Administration Safety Investigator in May 2013 to influence the safety investigator to produce a false compliance review of Dushku’s motor carrier company, Korca Enterprises.

According to FMCSA’s Safety Measurement System Korca Enterprises has exceed the intervention thresholds in the unsafe driving and hours of service compliance categories. It has a vehicle out-of-service rate of 55% for inspections, far above the national average. The company has just 6 vehicles and ran 5,000 miles in 2011, the latest year these last figures are available.

Dusku has reportedly agreed to plead guilty with prosecutors recommending probation, home confinement, supervised released and a small fine.

Had he been tried and convicted he faced a maximum sentence of 15 years in prison, three years of supervised release and a fine equal to the greater of $250,000 or three times the value of the bribe.
