WNEP 16, Moosic, Pa., reported that a federal judge in Easton said a lawsuit challenging a toll increase for commercial trucks imposed by the Delaware River Joint Toll Bridge Commission has merits, but
truckers might not legally be able to mount a challenge in federal court.
The American Trucking Associations, the Pennsylvania Motor Truck Association, the New Jersey Motor Truck Association and Ohio-based Roadway Express filed a lawsuit in December 2002, a month after the bridge commission increased automobile and commercial truck tolls.
The plaintiffs want the current two-dollar, 75-cent per axle fee for commercial trucks reduced to two-25 per axle.
They claim the current fee is too high given that the commission has a surplus of $118 million -- almost three times its $40 million operating budget.
