The U.S. Environmental Protection Agency is proposing to exempt milk containers and associated piping and appurtenances from Oil Spill Prevention, Control, and Countermeasure requirements.


The containers, piping, and appurtenances must be constructed according to current applicable 3-A Sanitary Standards, and are subject to the current applicable Pasteurized Milk Ordinance (PMO) or a state dairy regulatory requirement equivalent to the current applicable PMO. The capacity of these milk containers would not be included in a facility's total oil storage capacity calculation.

These amendments do not remove any regulatory requirement for owners or operators of facilities in operation before August 16, 2002, to develop, implement and maintain an SPCC plan in accordance with the SPCC regulations then in effect. Such facilities continue to be required to maintain their plans during the interim until the applicable date for revising and implementing their plans under the new amendments.
