Q. Is an ELD provider required to notify its fleet customers if its ELD solution has been removed from the FMCSA’s ELD registration list due to non-compliance?

A. No, ELD providers are not required to notify its customers their devices have been removed from the ELD registration list due to non-compliance.

 The FMCSA will maintain on its website a list of devices it has removed from the list — and take steps to make sure the industry is aware of any determinations of device non-compliance.

 Fleet managers should be vigilant about any change in status of the fleet’s ELD solution. If a fleet driver is using a device that’s found to be out of compliance, the fleet and the driver may face a citation, fine, or being placed out of service, even if the fleet was using the device in good faith.
