Internet load board Getloaded.com has filed an appeal asking the 9th U.S. Circuit Court of Appeals to overturn a lower court verdict and fines of $510,000 in a civil case.
The original suit was brought by a competing Internet load board, Internet Truckstop, which claimed that one of its former employees had improperly provided Getloaded.com with customer data and other proprietary information hacked from the Internet Truckstop site.
Internet Truckstop said the information was used to help develop Getloaded.com, which launched in 1999. Internet Truckstop, the first Internet load board, has been in business since 1995.
The Idaho jury found in Getloaded.com’s favor on one element of Internet Truckstop’s suit, but sided with Internet Truckstop in three others, awarding $150,000 for each violation and and additional $60,000 for trade secret misappropriation, for a total of $510,000. The judge added additional penalties and issued an injunction against Getloaded.com.
In its appeal, Getloaded admits that its personnel engaged in misconduct but says that those people have been fired. The company is appealing the penalties on a number of grounds. Internet Truckstop opposes Getloaded.com’s appeal.
