Sterling Truck was wrong in refusing to provide the Acterra model truck to some 50 dealers as part of their franchise agreement,
an arbitrator (a retired federal judge) ruled late last year.
The dealers had filed a single arbitration to settle the issue of whether Acterra is a separate line make or another Sterling model -- an issue typically referred to as a "franchise within a franchise." Sterling, a subsidiary of Freightliner, contended the Acterra was a new franchise. The dealers asserted it was part of the Sterling product line.
With the ruling, those dealers will get the Acterra line.
