The U.S. Supreme Court will expand its review of Environmental Protection Agency rulemaking authority to decide whether or not the agency must make cost/benefit considerations part of its rulemaking process.

The court recently agreed to hear the government’s appeal of a 1999 court ruling that the agency overstepped its authority when it issued tough new emissions standards two years earlier. Now the court says it will also hear a cross-appeal by an industry coalition led by the American Trucking Assn’s which challenged the lower court's rejection of its argument that cost must be a consideration in setting new emissions standards. A ruling is expected in 2001.
