Q. I’ve heard that the FMCSA is considering making changes to the HOS rules? Is that true, and is there any way my company can submit comments about these proposed changes?

A. Yes, the Federal Motor Carrier Safety Administration (FMCSA) is considering making a number of changes to the hours of service (HOS) rules. The soon-to-be-published Advanced Notice of Proposed Rulemaking (ANPR) also known as a “pre-rule” was announced on August 21. HOS rules that may be revised include, expanding the 100 air-mile “short haul” exemption, extending the current 14-hour on-duty limitation under certain circumstances, revising the mandatory 30-minute break rule, and reinstating the option of splitting up off-duty rest breaks for drivers operating trucks with a sleeper-berth compartment. The ANPR can be viewed in its entirety here. Full details and submission instructions are available in the ANPR. While a deadline for submission has yet to be announced, it will be 30 days after publication in the Federal Register.

Q. I have an AOBRD, why do I need an ELD?

A. Technically you do not need to switch your automatic onboard recording device (AOBRD) to an electronic logging device (ELD) until December 16, 2019. According to the Federal Motor Carrier Safety Administration (FMCSA), trucks equipped with AOBRDs that meet the requirements of CFR 395.15 have two additional years to meet the ELD rule.
