A. The short answer is both of you. Although the ELD is a record of the driver’s RODS - and, on the fact of it, the sole responsibility of the driver to be accountable for it - the driver and the fleet, in fact, share responsibility for the accuracy of the records. The driver certification of his or her RODS is designed - in part - to protect drivers from unilateral changes by fleet personnel.
