Q. Who is responsible for the accuracy of records of duty status (RODS) regarding edits and certifications — the driver or the fleet?

A. The short answer is both of you. Although the ELD is a record of the driver’s RODS - and, on the fact of it, the sole responsibility of the driver to be accountable for it - the driver and the fleet, in fact, share responsibility for the accuracy of the records. The driver certification of his or her RODS is designed - in part - to protect drivers from unilateral changes by fleet personnel. However, if the driver is unavailable or unwilling to rectify the record after it is corrected for accuracy, the fleet’s proposed edit and annotation will remain part of the record.
