Q. It’s my understanding that U.S. fleets have exemptions that allow them not to use an ELD. Will there be similar exemptions in the Canadian ELD mandate?

Yes, under the upcoming Canadian ELD regulations, commercial motor vehicles will be exempt if they:

  • Operate under a specific permit issued.
  • Have a statutory exemption.
  • Are subject to a rental agreement with terms under 30 days.
  • Were manufactured before 2000.

For drivers operating vehicles manufactured before 2000, they will be allowed to continue using paper logs to track their on-duty driving hours.

While you may think you have exempt vehicles, it’s important to get verification from a third party to help ensure you’re operating in compliance with the regulation. Consult either Transport Canada or your company’s legal team to determine if you can in fact take an exemption.
