ABF Freight System is continuing on in its nearly two-year legal battle with the International Brotherhood of Teamsters and several YRC subsidiaries.
ABF announced last week that it had filed a notice of appeal seeking review in the United States Court of Appeals for the 8th Circuit. This appeal comes after an Aug. 1 decision by Judge Susan Webber Wright of the U.S. District Court for the Western District of Arkansas to again dismiss the suit brought by ABF's subsidiary Arkansas Best Corp.
The judge originally dismissed the suit in December 2010, but the U.S. Court of Appeals for the Eighth Circuit reversed the dismissal in July 2011.
ABF originally initially filed legal action in Nov. 2010 against the Teamsters and various YRC subsidiaries for violation of the National Master Freight Agreement, claiming the concessions the union made in its negotiations with struggling YRC were not allowed under the NMFA.
