Horton Inc. and Kit Masters have reached an agreement to settle their pending litigation against each other regarding engine fan-drive products.
Horton had a complaint against Kit Masters for alleged patent infringement, and Kit Masters had countersued.
Another claim by Horton involving a two-speed eddy current drive device is still active, the company said in a statement.
Under the settlement, Kit Masters will stop selling its HTS-2 speed, 88-2S and 98001 products, and Kit Masters will drop its counterclaim against Horton involving those products. Complete terms of the settlement agreement are confidential.
Horton's suit alleged infringement of two patents, Nos. 5,636,719 and 7,533,764. Horton says its litigation against Kit Masters remains ongoing for infringement of U.S. Patent Nos. 6,838,796 and 5,611,415 by Kit Masters' GoIdTop product.
Horton, of Roseville, Minn., makes eddy current fan drive products, including the DriveMaster and DM Advantage Two-Speed Fan Drives, and the PolarForce Two-Speed Conversion Kit for truck and industrial applications. Kit Master, of Perham, Minn., sells remanufactured fan drives for several engine and equipment lines.
