The Truck Rental and Leasing Assn., or TRALA, has sponsored an amendment to exempt truck lessors from liability for diesel engine idling violations committed by customers
in Illinois. The amendment was adopted by the Illinois Senate last month.
The TRALA amendment was added to IL House Bill 2347, a bill to establish idling restrictions on vehicles with a GVWR of more than 8,000 pounds. As introduced, the bill would have held the vehicle owner liable for idling violations. TRALA worked with the bill sponsor, Rep. Elaine Nekritz (D-Des Plaines), to draft the amendment that would make the vehicle operator liable for idling violations.
TRALA is working through the U.S. EPA’s Smartway Program to develop similar protections for lessors in other states. TRALA’s intent is to include language in draft model legislation that addresses the lessor/lessee idling issue.
