The U.S. Supreme Court on Friday accepted cases brought by the American Trucking Associations, USF Holland and Mid-Con Freight Systems Inc.
U.S. Supremes To Decide Michigan Truck Tax Case
against the Michigan Public Service Commission.
Truckers want the justices to stop Michigan from charging $100 yearly fees. Michigan Solicitor General Thomas Casey said fees are used to enforce safety regulations.
An appeals court upheld the charges, noting the state's interest in regulating highway safety.
Critics contend the fees are unusually high and, if imposed by other states, “would impose potentially crushing, cumulative burdens on trucks traveling in interstate commerce," said Washington attorney Charles Rothfeld, representing the ATA.
The state lost a truck fees case at the high court nearly three years ago. About $70 million is at stake in the latest challenge.
