The U.S. Equal Employment Opportunity Commission has filed suit against United Parcel Service,
claiming the company violated the Americans With Disabilities Act when it did not reassign a diabetic driver.
According to published reports, a driver who was diagnosed with diabetes in 1998 was no longer able to drive a UPS truck because he was disqualified from getting a commercial driver’s license. The EEOC said under the terms of ADA, UPS should have reassigned the driver to a nondriving position.
UPS told the Associated Press that it feels the lawsuit is misguided and it will “defend itself vigorously” in the case. The company says the plaintiff does not qualify as disabled because his condition is controllable with medication.
