DFC Transportation Co., formerly a subsidiary of Dean Foods, has filed suit against former officers alleging unfair competition.

DFC is suing Kelly Scott Harm, Barry Kevin, Susan Serio and Cheri Mc Nall, and their newly formed company, K & S Transportation Inc. of Elgin, Illinois.
The suit claims that the defendants started K & S to lure away DFC’s customers and shipper agents, in violation of non-competition agreements that were in place and executed by the defendants. In addition, the suit alleges violation of the Illinois Trade Secrets Act, Breach of Contract and Tortuous Interference with Prospective Economic Advantage.
A preliminary injunction was entered on July 1 against one of the defendants, Barry Kevin of Oshkosh, Wis., with the judge finding of a likelihood of the lawsuit’s success on the merits and a potential of irreparable harm. DFC plans to start taking depositions of the other defendants to try to get injunctions against them, as well.
DFC says it can trace more than $3 million in lost business already to the defendants’ actions.
DFC Transportation was sold earlier this year by Dean Foods and specializes in temperature-controlled transportation.
