Kroger Co. will pay $55 million to a trucker injured when he was crushed between two trucks after the U.S. Supreme Court refused to overturn a 1999 jury award.

Jerry Stanton, a driver with an Illinois trucking company, was injured in Indianapolis in May 1995. He spent 243 days in the hospital and underwent several surgeries.
Stanton and his wife sued Kroger and the driver for negligence and loss of consortium. Kroger attorneys said Stanton should have been more alert.
The jury did agree that Stanton was partly at fault, reducing its original $68.7 million award by 20 percent as a result.
