Truck drivers providing emergency assistance to the New York City area may be exempt from federal hours-of-services rules.

Part 390.23 of the federal motor carrier safety regulations provide for temporary exemptions when an emergency has been declared by authorized federal, state or local government officials. According to an FMCSA official, qualifying assistance may be direct involvement in the rescue effort or the transportation of vital goods such as food.
Carriers can request exemptions for their drivers by sending a fax to the New York FMCSA office, (518) 431-4140, attention Brian Temperine, FMCSA division administrator. The fax should include the name of the carrier, the U.S. DOT identification number, and a brief description of the assistance being provided.
