A South Dakota bill would bar local governments from prohibiting engine brakes.

HB1166 is sponsored by state Rep. Frank Kloucek, who said truckers must be able to use engine brakes when needed. Some counties and towns have banned the use of Jake Brakes and other engine brakes because of the noise. Instead, the law would allow only the banning of unmuffled exhaust brakes.
Rep. Dale Hargens said exhaust brakes are a safety feature and should not be banned.
Opponents say the state Legislature shouldn't tell local governments what to do about noise and traffic. Rep. Tom Hennies said that truckers could still use Jake Brakes in an emergency, even if towns prohibit them.
The bill cleared the House Local Government Committee and goes next to the House floor.
