Sixteen ballots have been challenged in the Teamsters representation election at less-than-truckload carrier SAIA Motor Freight in Grand Prairie, TX, where the union lost by only one vote.
After a 10-month organizing effort by the Teamsters, which included several unfair labor practice charges filed by the union with the National Labor Relations Board, the vote was against the union, 171-170.
The NLRB staff supervising the election challenged three of the ballots, and the union challenged another 13. It could take a month or more before the final outcome is determined.
The company and the union have seven days to file objections on the conduct of the election. With a vote this close, objections are common, according to a NLRB spokesman.
Rick O'Dell, president of SAIA, said the company is "confident that the outcome of the challenged ballots will be in our favor." O'Dell said the vote continues SAIA's record of never having had a union in its 75-year history. Formerly family owned, SAIA is now a subsidiary of Yellow Corp.
Last November, The NLRB filed a complaint against Atlanta-based SAIA, charging that the company illegally interfered with and tried to intimidate pro-union employees at the Grand Prairie terminal.
