Violations of the electronic logging device rule found during roadside inspections since full enforcement kicked in on April 1 are now being used in the Safety Measurement System that drives the Federal Motor Carrier Safety Administration’s Carrier, Safety, Accountability enforcement program.

Truck Drivers Operating Without ELD May Now be Put Out of Service

Now that the April 1 "hard enforcement" deadline has passed on the electronic logging device mandate, property-carrying commercial motor vehicle drivers operating their vehicle without a required registered electronic logging device or a grandfathered automatic on-board recording device will be placed out of service for 10 hours, according to CVSA.

The FMCSA is granting an additional 90-day temporary waiver from the electronic logging rule for “agriculture-related transportation.” During that time period, the agency says it will also publish "final guidance" on both the agricultural air-mile exemption within the hours of service rule and on the use of the personal conveyance adjustment by all motor carriers operating under the ELD rule.

Although the Federal Motor Carrier Safety Administration launched a demonstration program last August last summer that invited motor carriers to request a data review of certain non-preventable crashes, only now is the agency releasing “additional information to help submitters and other interested parties understand the demonstration program.”

ELD Violations Won't Count Against CSA Scores During Transition Period

Federal officials have taken another step to make the transition to mandatory electronic devices less painful. If drivers are cited at roadside for not complying with the ELD rule come the Dec. 18 deadline, the citation will be a “no points cite” that will not affect the Safety Measurement System that feeds into CSA scores – until April 1.

ORLANDO - Boiled down to its essence, the review of the Compliance, Safety, Accountability program by the National Academies of Science found that the Federal Motor Carrier Safety Administration should move to a more scientific method to drive the Safety Measurement System that signals which motor carriers are at highest risk for future crashes, according to an FMSCA official.
