Study: New HOS Rules Result in Productivity Losses

The American Transportation Research Institute on Monday released the findings of its latest analysis of the operational and economic impacts resulting from the new hours-of-service rules that went into effect July 1.

The changes to the Hours-of-Service rules implemented by the Federal Motor Carrier Safety Administration include provisions, which limit use of the 34-hour restart and require a rest break before driving after 8 hours on-duty.

Among the operational and economic impacts identified by ATRI are:

  • More than 80% of motor carriers surveyed have experienced a productivity loss since the new rules went into effect, with nearly half stating that they require more drivers to haul the same amount of freight.
  • Among commercial drivers surveyed by ATRI, 82.5% indicated that the new HOS rules have had a negative impact on their quality of life, with more than 66% indicating increased levels of fatigue.
  • Commercial drivers are forced to drive in more congested time periods, although the FMCSA Regulatory Impact Analysis did not address increased safety risks with truck traffic diversion to peak hour traffic.
  • The majority of drivers, 67%, report decreases in pay since the rules took effect.
  • The impacts on driver wages for all over-the-road drivers total $1.6 billion to $3.9 billion in annualized loss.

ATRI’s analysis is based on industry survey data of over 2,300 commercial drivers and 400 motor carriers as well a detailed analysis of logbook data representing more than 40,000 commercial drivers.

“We anticipated significant impacts on our operations and across the entire supply chain from the new rules and our experience since July 1st is bearing that out,” said Kevin Burch, president of Jet Express and American Trucking Associations vice chairman. “ATRI’s analysis clearly documents the productivity impacts and real financial costs being borne by carriers and drivers. It’s only a matter of time before these impacts ripple throughout the nation’s economy.”

    Darn, I even knew the outcome would hurt the industry. Common sense is no longer the rule, politically correct is the new rule. Shame on the government believing that one rule is for everyone in this industry.

    Whenever there is a change in our rules, we driver and/or companies loose, both with dealing with mhore safety hazards, loss in time to deliver loads on time-which means companies can't have an efficient production system, and finnally, and most importantly, the bottom line of money in lost.

    One size fits most. Doesn't work for trucking, doesn't, work for health insurance... Wonder if anybody will be brave enough to break the cycle. We can only hope there is one live brain cell in government.

    Who needed a million dollar study to figure this out? arbitrary rules that restrict the individuals freedom of movement negatively affect everything and everyone. individual accountability and free choice is the only way to govern anything...The excessive, burdensome laws that government has imposed on transportation in the last 20 years discourages people from long term employment in the field.....there is much whining from employers about driver shortages when there is no driver shortage, there is a shortage of people willing to work in an industry that abuses, mistreats and disrespects workers on such a wide scale...transportation customers are the true root of the problem especially in the temperature controlled segment and trucking companies that service them only enable the abuse to continue...HOS rules are 100% garbage and only cripple the industry as a whole...These rules are politically motivated to somehow try to raise employment figures or some such nonsense but they only serve to diminish individual pay and freedom, industry efficiency, and quality of life in general.

    I changed carreers after the 14 hour rule was implemented after 28 years best thing I've ever done. Let the feds.drive the trucks!

    If you think this is reducing productivity, just wait till the ass clowns get the eobr law passed. i personally believe that this was a test. A small sampling of the main course. These large companies know that these laws , while inconvenient to them , will be devastating to small outfits. Then once in place , drivers won't be able to go to a carrier that doesn't use them. Very smart use of their resources. Buy a politician or 3 and away they go. They are able to do to an industry what all the other factors haven't been able to achieve. Please someone with common sense and power save us from these clowns.

    If the new HOS 34 rule doesn't destroy the trucking industry the E-Logs will bring it to its knees. Example: By the time we load up in Southern Cal. Deal with the traffic, it will be time to go to sleep in Indio... Any one that drives knows this is the truth. Anne Ferro just had a personal experience with regard to what we go through. If she would have rode with that Owner Op. for a week she would have seen the entire picture. Maybe Mr. Foxx ought to do the same so he could get the picture... As long as these people sit behind a desk, they will never know what we go through. When some thing becomes over regulated, it falls apart.

    This study was done by ATRI - American Transportation Research Institute and not the ATA as one poster indicated. ATRI is non political and produces very good research and data.

    I agree that it's not a hge surprise that the new rules would reduce productivity. If safety is enhanced however I could support these changes. However the FMCSa has never really produced the science to support these changes which leads to the concern that this more politics and less a scientifically proven need.

    ATRI is "part of the American Trucking Associations Federation," according to its website. We often call it "the research arm of ATA."

    I am going to loose $15 - 20,000 in earnings for 12 months between July 2013 and July 2014 based on what the 1-5 mandate and 168 hour reset has done to me...Why, Why did the arrogant and numbness of an agency from the Obama Administration claiming to be for the "middle Working Class" kick us so hard in the teeth that we have to reduce our living standards?
