TCA Audio Conference Addresses Owner-Operator Lawsuits

An audio conference titled "Avoiding Owner-Operator Lawsuits" will be held from noon to 1:30 p.m. (EST) Friday, July 20, 2007, aimed at CEOs, CFOs, leasing program directors, and general counsels, among others.

It will focus on costly lawsuits brought by owner-operators against motor carriers, large and small. The live event will summarize the latest developments in court and address the two keys to avoiding being sued - namely, drafting a proper independent contractor operating agreement and making your leasing practices match your lease provisions.
Subject expert Daniel R. Barney of Scopelitis, Garvin, Light & Hanson will also discuss the legal pitfalls - and the drafting and implementation choices available to minimize them - relating to compensation, charge-backs, forced purchases, insurance, escrow funds and independent contractor versus employee status. An outline of an independent contractor operating agreement, with specific wording, numbers and responsibilities left for each carrier to determine on its own, will be distributed and discussed.
